 Representative Complex Litigation and Class Action Cases in which
David M. Cohen served as Lead Counsel, Co-Lead Counsel or Class Counsel

 Jeffrey S. Vodenichar et al., v. Halcon Energy Properties, Inc. et al., 2013-512 (Mercer County, Pa.) - litigation on behalf of approximately 1,500 landowners for breach of contract relating to oil and gas leases. Final approval of a $5,950,000 class settlement was granted in October, 2016.   

• In re Cobb EMC Class Action, 10:100353-48 (Cobb County Sup. Ct., Ga.) - class action litigation on behalf of members of Cobb EMC for return of patronage capital. The case resulted in a nationwide settlement in February, 2014 valued at approximately $100,000,000.  

• Edgar “Bo” Pounds et al., v. Cobb Electric Membership Corporation, Cobb Energy Management Corporation, et al., 07-1-9408 (Cobb County Sup. Ct., Ga.) – derivative litigation involving claims of corporate fraud, abuse of control, waste of corporate assets and breach of fiduciary duties against Cobb EMC, Cobb Energy and certain of their officers and directors. The case resulted in a settlement in 2008 valued at approximately $65,000,000. 

Jamie Norris et al. v. Protective Apparel Corp. of America, et al., CACE05012961 (Seventeenth Cir. Broward Co., Fla.) - warranty and consumer protection litigation. The case resulted in a nationwide settlement in 2006 valued at approximately $50,000,000. 

George King, Dennis Wilcox, et al. v. First Choice Armor & Equip. Inc., et al., 06CV10034 (D. Mass.) - warranty and consumer protection litigation. A nationwide plaintiff class and a multistate subclass were certified by the Court. The case resulted in a nationwide settlement in 2007 valued at over $15,000,000. 

Thomas Kiefer et al. v. Protective Products International, CACE05016039 (Seventeenth Cir. Broward Co., Fla.) – warranty and consumer protection litigation. The case resulted in a nationwide class settlement in 2006 valued in excess of $1,500,000. 

Scott Martin et al. v. Gator Hawk, Inc., 2005-CA001287 (Fourth Cir. Duval Co., Fla.) – warranty and consumer protection litigation. The case resulted in a nationwide class settlement in 2006 valued in excess of $3,250,000.

Southern States Police Benevolent Assn., Inc. et al. v. Armor Holdings, Inc., Armor Holdings Products, LLC and Safari Land Ltd., Inc., (“Armor II”) 2005-CA-5925 (Fourth Cir. Duval Co., Fla.) – warranty and consumer protection litigation. The case resulted in a nationwide class settlement in 2005 valued in excess of $33,000,000. 

Steven W. Lemmings, et al. v. SCBA, Inc., No. CJ-2004-64 (Mayes County Dist. Ct., Okla.) - warranty and consumer fraud litigation. The case resulted in a nationwide class settlement providing a cash fund of $29,000,000.

Southern States Police Benevolent Assn., Inc. et al. v. Armor Holdings, Inc., et al., (“Armor I”) 2004-2942 CA (Fourth Cir. Duval Co., Fla.) – warranty and consumer protection. The case resulted in a nationwide class settlement in 2004 valued in excess of $20,000,000.

Bradley Alexander et al. v. Point Blank Body Armor, Inc., 05000084 Seventeenth Cir in and for Broward County, Florida – warranty and consumer protection. The case resulted in a nationwide class settlement in 2004 valued approximately $2,000,000.

                               Representative Business Litigation and Consumer Fraud Cases

 PRA, Inc. et al. v. Melo International, Inc. et al., Case No. CV11761606 (Cuyahoga County, Ohio Civil Div.) - represented Defendant corporations in litigation against an underwriter and insurance agent. Settlement reached in March, 2013 with Plaintiffs dismissing all claims and paying $500,000 to resolve counterclaims for breach of fiduciary duty and fraud.

• First Choice Armor & Equipment, Inc. v. Toyobo Company Ltd. and Toyobo America, Inc., 09CV11380 (D. Mass.) – consumer fraud action against an Osaka, Japan based component part manufacturer and its U.S. based subsidiary that resulted in a $6,000,000 recovery in March, 2012.

Point Blank Solutions, Inc. et al. v. Toyobo Company Ltd. and Toyobo America, Inc., 09-61166 (S.D. Fla.) – consumer fraud and false advertisement action against an Osaka, Japan based component part manufacturer and its U.S. based subsidiary that resulted in a $6,000,000 recovery in July, 2011.
